Terms of Use

1. Acceptance of terms

These Terms of Use are a binding agreement between you and Alexarix Ltd. ("AnalogFax", "we", "us"). By using AnalogFax you agree to them. If you do not agree, do not use the service.

2. Service description

AnalogFax lets you upload documents and transmit them as faxes through our web platform, including delivery tracking, a fax history dashboard and secure document handling. The service is provided on an "as-is" and "as-available" basis for convenience purposes only.

3. Your responsibilities

• Provide accurate account information and keep your sign-in email secure.
• Use the service only for lawful purposes and respect the rights and privacy of others.
• Verify recipient fax numbers before sending and independently confirm delivery of important documents (e.g. by phone).
• Accept that fax technology has inherent limitations and is not 100% reliable.

4. Acceptable use

You may not use AnalogFax to send spam or unsolicited advertisements (including in violation of the TCPA and the Junk Fax Prevention Act of 2005), illegal, harmful or infringing content, or to interfere with our systems. AnalogFax is NOT a HIPAA-compliant service. We do not sign Business Associate Agreements and you must not transmit Protected Health Information or patient records. Violations may result in immediate termination without refund.

5. Fax transmission terms

We provide fax transmission on a reasonable-efforts basis and do not guarantee delivery, delivery within a timeframe, compatibility with every receiving machine, or the accuracy of delivery confirmations. We are not liable for failures caused by busy or unanswered lines, wrong or disconnected numbers, recipient equipment, network or carrier issues, or third-party providers. Delivery confirmations are courtesy notifications; you must verify receipt through independent means for important documents. Retries are a courtesy and carry the same limitations. The service must not be used for legal filings, medical emergencies, financial or regulatory deadlines, or any communication where a failed or late delivery could cause loss or harm.

6. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND WITHOUT ANY WARRANTY THAT FAXES WILL BE DELIVERED OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

7. Third-party services

We rely on third parties including telecommunications carriers (Telnyx) for fax transmission, Stripe for payments, Cloudflare for hosting and storage, and email providers for notifications. We are not liable for their failures, outages, or changes.

8. Subscription and billing

• Trial: $0.99 is charged immediately and gives 48 hours of access including up to 5 faxes.
• Automatic renewal: unless you cancel before the trial ends, your subscription starts automatically at $19.95 every 4 weeks and renews each period until cancelled. You authorize us to charge your payment method on file for these recurring payments.
• All prices are in US dollars. Payments are processed by Stripe; you receive an email receipt for each charge. The charge appears as "ANALOGFAX.COM" on your statement.
• Fair usage: plans include up to 50 faxes per 4-week period and 5 per day, with a maximum of 50 pages per fax. Excessive use may be limited or reviewed.
• Failed payments may result in suspension until payment is collected.
• Price changes will be announced by email at least 30 days in advance.

9. Cancellation

Cancel anytime from your dashboard (Account & billing → Cancel subscription), through the billing portal, without logging in at /cancel (we email you a one-click link), or by emailing support@analogfax.com. Cancellation takes effect at the end of the current paid period; you keep access until then and are not charged again. Cancelling does not entitle you to a refund for fees already paid.

10. Refund policy

All sales are final. If a transmission fails due to a verified error in AnalogFax's own infrastructure, we will credit that transmission or allow a free retry as your sole remedy. Failures caused by recipient equipment, wrong numbers, busy lines, networks or third-party providers do not qualify. Report failures within 48 hours. Billing disputes must be raised with support@analogfax.com within 30 days of the charge. See our Refund Policy.

11. Privacy

Our Privacy Policy forms part of these terms.

12. Intellectual property

AnalogFax and its content are owned by us. You keep ownership of your documents and grant us a limited licence to process and transmit them to provide the service.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Alexarix Ltd. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, LOSS OF PROFITS, DATA OR BUSINESS, MISSED DEADLINES, PENALTIES, OR FAILED TRANSMISSIONS FROM ANY CAUSE. OUR TOTAL AGGREGATE LIABILITY IS LIMITED TO THE LESSER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR $100. Some jurisdictions do not allow these limitations; there our liability is limited to the extent permitted by law.

14. Indemnification

You agree to indemnify and hold harmless Alexarix Ltd. and its officers, employees and agents from claims arising from your use of the service, the content you transmit, your violation of these terms or of applicable law, or claims by recipients of your faxes.

15. Termination

We may suspend or terminate accounts that violate these terms, engage in fraud or abuse, fail to pay, or pose a legal or security risk.

16. Changes

We may update these terms; material changes will be announced by email at least 30 days in advance. Continued use after the effective date constitutes acceptance.

17. Dispute resolution

Any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring an individual claim in small claims court. You and AnalogFax waive the right to a jury trial and to participate in class actions. You may opt out of arbitration by emailing support@analogfax.com with the subject "Arbitration Opt-Out" within 30 days of first accepting these terms.

18. Governing law

These terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules. Nothing in these terms limits non-waivable consumer rights under your local law.
